Robins Financial Credit Union Bill Pay Agreement
This Bill Payment Agreement is between Robins Financial Credit Union and each member who has enrolled in our Robins Financial Bill Pay, together with any person you have authorized to use or access Robins Financial Bill Pay on your behalf.
You may use Robins Financial Credit Union?s bill paying service, Robins Financial Bill Pay, to direct Robins Financial Credit Union ?Credit Union? to make payments from your designated account to the ?Payees? you choose in accordance with this agreement. The terms and conditions of this agreement are in addition to the account agreements, disclosures and other documents in effect from time to time governing your account.
In this Agreement, the words ?you,? ?your,? and ?ours? mean those who sign the application or account card as applicants, joint owners, or any authorized users. The words ?we,? ?us,? and ?our? mean the Credit Union. ?Payee? means anyone, including the credit union, that your member designates to pay and the credit union accepts as payee.
Availability
Robins Financial Bill Pay is generally accessible 24 hours a day, seven days a week. Robins Financial Bill Pay may be inaccessible for a reasonable period weekly to perform system maintenance.
Payees
The Credit Union reserves the right to refuse the designation of a ?Payee? for any reason. You may pay any ?Payee? within the United States (including U.S. territories and APO?s / AEO?s). The credit union is not responsible for payments that cannot be made due to incomplete, incorrect, or outdated information.
Prohibited Payees
We will not process payments on your behalf to payees meeting any of the following criteria:
? Designated by the Office of Foreign Asset Control (OFAC) as being a prohibited payee
? Having an address outside of the United States (except for APO/AEO)
Bill Payment Limits
We may establish limits on the dollar amount and/or number of items from time to time through Bill Pay. Limits may be changed at any time at our discretion. If you attempt to initiate a payment in excess of these limits, we may reject your payment. If we permit you to make a payment in excess of these limits, such payment will still be subject to the terms of this Agreement, and we will not be obligated to allow such payment at other times.
Single Payments
A single payment will be processed on the business day (generally Monday through Friday, except for Financial or state holidays) that you designate as the payment?s processing date, provided the payment is submitted prior to the daily cut-off time on that date. The daily cut-off time is currently 4:00PM EST.
A single payment submitted after the cut-off time on the designated process date will be processed on the next business day. If you designate a non-business date (generally weekends and certain holidays) as the payment?s processing date, the payment will be processed on the first business day following the designated processing date.
Recurring Payments
When a recurring payment is processed, it is automatically rescheduled by the system. Based upon your selected frequency settings for the payment, a processing date is calculated for the next occurrence of the payment. If the calculated processing date is a non-business date (generally weekends and certain holidays), it is adjusted based upon the following rules:
? If the recurring payment?s ?Pay Before? option is selected, the processing date for the new occurrence of the payment is adjusted to the first business date prior to the calculated processing date.
? If the recurring payment?s ?Pay After? option is selected, the processing date for the new occurrence of the payment is adjusted to the first business date after the calculated processing date.
Note: If your frequency settings for the recurring payment specify the 29th, 30th, or 31st as a particular day of the month for processing and that day does not exist in the month of the calculated processing date, then the last calendar day of that month is used as the calculated processing date.
Single and Recurring Payments
The system will calculate the Estimated Arrival Date of your payment. This is only an estimate, so please allow ample time for your payments to reach your ?Payees?.
Cancelling a Payment
We may cancel a bill payment if we have a reasonable belief that the payment is fraudulent. If we cancel a payment, we will attempt to contact you to inform you of this action. A bill payment can be changed or cancelled any time prior to the cutoff time on the scheduled processing date.
When scheduling a bill payment, note the difference between the ?Process Date?? date and the ?DELIVER BY? date. The ?Process date? is the date we will attempt to deduct the payment amount from your designated account.
Fees
Robins Financial Bill Pay service imposes no monthly service charges. Fees apply for certain types of activity, including savings overdraft, insufficient funds, check copy, and stop payment.

Liability
? If you want to terminate another person's authority to use the Bill Pay service, you must notify the Credit Union and arrange to change your PIN.
? You will be responsible for any bill payment request you make that contains an error or is a duplicate of another bill payment.
? The Credit Union is not responsible for a bill payment that is not made if you did not properly follow the instructions for making a bill payment.
? The Credit Union is not liable for any failure to make a bill payment if you fail to promptly notify the Credit Union after you learn that you have not received credit from a ?Payee? for a bill payment.
? The Credit Union is not responsible for your acts or omissions or those of any other person, including, without limitation, any transmission or communications facility, and no such party shall be deemed to be the Credit Union?s agent.
Liability for Unauthorized Access
You are responsible for all transactions you authorize using Robins Financial Bill Pay under this Agreement. If you permit other persons to use your access code, you are responsible for any transactions they authorize or conduct on any of your accounts. However, tell us at once if you believe anyone has used your access code and accessed your accounts without your authorization. If you tell us within two (2) business days, you can lose no more than $50.00 if someone accessed your account without your permission. If you do not tell us within two (2) business days after you learn of the unauthorized use of your account or access code, and we can prove that we could have stopped someone from accessing your account without your permission if you had told us, you could lose as much as $500.00.
MEMBER RESPONSIBILITIES AND WARRANTIES
Security
You are responsible for keeping your user id, password, and account data confidential. We are entitled to act on transaction instructions received through your user id and password. Our Call Center personnel are entitled to act on instructions after they have properly authenticated the caller according to our internal procedures.
Joint Accounts
If any of the accounts that you register under Robins Financial Bill Pay is a joint account, you confirm that your joint account holder has consented for you to use that accounts with Web Bill Pay. We will end your use of Web Bill Pay if any joint account holder notifies us that (i) they never consented to your use of Web Bill Pay, (ii) the joint account can no longer be operated on your instructions alone, or (iii) they are withdrawing consent for you to operate the joint account.
General Warranties
You warrant and represent that the information you are providing us with is true, correct and complete.
You agree not to impersonate any person or use a name that you are not authorized to use. You agree to promptly update your registration records if your e-mail address or other information changes.
You warrant that you will not use Robins Financial Bill Pay for any purpose that is unlawful or is not permitted, expressly or implicitly, by the terms of this Agreement or by any applicable law or regulation. You further warrant and represent that you will not use this service in any manner that could damage, disable, overburden, or impair Robins Financial Bill Pay or interfere with any other party?s use and enjoyment of Robins Financial Bill Pay.
ROBINS FINANCIAL CREDIT UNION?s RESPONSIBILITIES AND WARRANTIES
If we do not provide a bill payment instruction on time, if we cause an incorrect amount to be removed from an account or if we cause funds from an account to be transferred to any account other than the account or payee?s account specified in the applicable bill payment instruction, we shall be responsible for returning the improperly transferred funds and/or for directing any misdirected funds to the proper account or intended payee?s account.
We are liable for any losses and damages arising from our gross negligence or willful misconduct or if we breach a representation or warranty to you.
Limits of Robins Financial Credit Union?s Responsibilities
EXCEPT AS EXPRESSLY SET FORTH ON OUR WEB SITE OR IN THIS AGREEMENT, WE DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING NON-INFRINGEMENT OF THIRD PARTY INTELLECTUAL PROPERTY RIGHTS.
WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND RESULTING FROM THE USE OF OR THE INABILITY TO USE THE ROBINS FINANCIAL WEB BILL PAY, INCLUDING DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLES, EVEN IF WE HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Privacy and Security

As is more fully described in the ?Security Policy? link, we have multiple levels of security that have been designed especially for us and all of your personal and financial information will be placed on a secure portion of our website. We do not use any persistent ?cookies? on the browser to store any personal information.
As discussed in more detail in the ?Privacy Policy? link, we will only disclose information to third parties about your account or the bill payments you make:
? Where it is necessary for completing bill payments, or
? In order to comply with government agency or court orders, or
? If you give us your written permission.
Error Reporting Process
In case of errors or questions about Robins Financial Bill Pay, funds transfers from your savings or checking accounts or if you need more information about a transfer on the statement or receipt, telephone us at the following number or send us a written notice to the following address as soon as you can. ? Describe the web bill payment or electronic transfer you are unsure about and explain, as clearly as you can why you believe the Credit Union has made an error or why you need more information.
? Tell us the dollar amount of the suspected error.
If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) business days.
We will determine whether an error has occurred with ten (10)* business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will credit your account within ten (10)* business days for the amount you think is in error so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10)* business days, we may not credit your account.
We will tell you the results with three (3) business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.
*If you give notice of an error within 30 days after you make the first deposit to your account, we will have 20 business days instead of ten (10) business days to investigate the error.
Termination
We reserve the right to suspend or terminate access to Robins Financial Bill Pay for any reason without notice.
You may not terminate your participation in Robins Financial Bill Pay if you have outstanding bill payments scheduled. If you have no outstanding bill payments you can terminate service participation by contacting the Credit Union.
? You may terminate this agreement by written notice to the credit union.
? The credit union is not responsible for any fixed payment made before the Credit Union has a reasonable opportunity to act on your termination notice.
? You remain obligated for any payments made by the credit union on your behalf.
Amendment
Robins Financial Credit Union has the right to change this agreement at any time by notice mailed to you at the last address shown for the account on the credit union?s records, by posting notice in branches of the credit union, or as otherwise permitted by law.
