BILL PAYMENT SERVICE AGREEMENT/DISCLOSURE

FEE SCHEDULE
You will not be charged for actively using STC OnLine BillPay. A $5.00 inactivity fee will be charged if no payments are made during any 2-month period based on the anniversary date of your enrollment. As long as at least one payment is made during the 2-month period, your account will not be charged. If you do not use the service during a 2-month period based on your enrollment date, your account will be charged the $5.00 inactivity fee. If you use the service during the next 2-month period, you will not be charged.

INTRODUCTION
Somerset Trust Company Bill Payment Service allows you to pay your bills and schedule bill payments from your designated checking account to the Payees you choose in accordance with this agreement. Our unique eBill service enables you to bring together, in one convenient location, summary information from as many of your bills as you wish, provided that these billers, selected by you, make this information available in an acceptable manner for online retrieval. You should carefully read this Bill Payment Service Agreement/Disclosure and review the Somerset Trust Company OnLine Banking Service Agreement (Terms and Conditions) as they exist and as may be amended from time to time and any applicable fee schedules before you use Somerset Trust Company’s Bill Payment Services.
All previously disclosed terms, limitations, conditions and agreements which govern your account(s) for bill payment service remain fully in effect regarding the account (s).

DEFINITIONS
References to “the bill payment service” or “service” within this agreement reflect the bill payment or eBill services offered by Somerset Trust Company or its designee. “You” and “your” refer to each person or business that has enrolled in the bill payment service and who is authorized to use the service. “We”, “us”, “our” and “Bank” refers to Somerset Trust Company.
• “Business Day” is every Monday through Friday, excluding Federal Reserve holidays.
• “CHECK Payment” is an actual paper check that is sent to your payee if the payee is not established as an electronic payee. Your name and payee account number will be referenced on the paper check to ensure proper credit to your payee account. Paper check payments will be drawn on your bill payment account and funds are debited from your account whenever the check clears.
• “Daily cut-off time” is 2:00 PM EST, business days only. SEE section WHEN PAYMENT SHOULD BE SCHEDULED for more information.
• “Due Date” is the date reflected on your payee bill or statement as the date the payment is due.
• “ELECTRONIC Payment” is an electronic payment that is sent to payees that are established to receive electronic payments and credit your account accordingly.
• “Payee” is the merchant, biller, entity, or person to whom you wish to send a payment.
• “Primary Bill Payment Account” is your Somerset Trust Company checking account that you have designated as the default account from which bill payments will be made.
• “Process Date” Single payments are processed on the business day you designate the payment to be processed, provided the payment request is received prior to the cut-off time. Recurring payments will be processed on the dates you have designated, unless such date falls on a non-business day resulting in your payment being processed on the next business day.PAYMENTS ARE DEBITED OR TAKEN FROM YOUR DESIGNATED ACCOUNT AND SENT WITHIN 24 HOURS OF THE PROCESS DATE.
• “Transfer Account” is an account in your name at another financial institution that you have designated and set up as a transfer account. You can transfer funds to and from this designated account to your primary bill payment account.

HOW TO SET UP PAYEES/PAYMENTS
TO ADD A NEW PAYEE, USE ”Add a Payee” WITHIN STC OnLine BillPay OR SPEAK TO A SERVICE REPRESENTATIVE. You may add a new fixed payment to a Payee by accessing the Service and entering the appropriate information. Most other additions, deletions, or changes can be made by using the Service. By providing the names and account information of Payees, you authorize the Bank and its third party service providers to provide the bill payment service and to follow the payment instructions received through the bill payment service. In order to process payments more efficiently and effectively, the bill payment service may edit or alter payment data or data formats in accordance with Payee directives, although the Bank is not responsible for editing the information you enter. When a payment instruction is entered, you authorize the bill payment service to debit your deposit account and remit funds on your behalf. The Bank, through the bill payment service, will use its best efforts to make your payments properly. However, the Bank and its service providers shall incur no liability if the bill payment service is unable to complete any payments initiated by you because of the existence of any one or more of the following circumstances:
1. If, through no fault of the bill payment service, your deposit account does not contain sufficient funds to complete the transaction or the transaction would exceed the credit limit of your overdraft protection;
2. If the bill payment service is not working properly and you know or have been advised about the malfunction before you execute the transaction;
3. If you have not provided the correct payment information or the correct name, address, phone number or account information for the Payee;
4. If circumstances beyond the control of the Bank or the bill payment service (including without limitation fire, flood, external interference, postal service delays, etc.) prevent the proper execution of the transaction; and/or
5. If the Payee you designate mishandles or delays processing a payment sent through the bill payment service.
The Bank reserves the right to refuse the designation of a Payee for any reason. You may pay any Payee within the United States (including U.S. territories and APO’s / AEO’s), subject to the section entitled “Prohibited Payments” below. The following types of payments through the bill payment service may be scheduled, but are strongly discouraged and are at your own risk: tax payments; payments for stock purchases; court ordered payments; payments associated with purchases of real property, annuities or lottery contracts, lay-away systems, or transactions to finance or refinance debts funded by a credit card; payments involving credit repair or debt settlement services; payments for the sale of items before the seller has control or possession of the item; payments associated with the following “money service business” activities: the sale of traveler’s checks or money orders, currency dealers or exchanges or check cashing. Except as otherwise specified by Regulation E (see Regulation E disclosure) the Bank shall not be liable for any claims, damages, losses, or late fees in connection with these types of payments. Further, the Bank has no obligation to research or resolve any claim resulting from this type of payment.
The Bank is not responsible for payments that cannot be made due to incomplete, incorrect, or outdated information. We advise you to review your payee information before you schedule a payment.

WHEN PAYMENTS SHOULD BE SCHEDULED
FOR ‘ELECTRONIC’ PAYMENTS, YOU MUST ALLOW A MINIMUM OF THREE (3) BUSINESS DAYS FOR PAYMENT TO REACH YOUR PAYEEFOR ‘CHECK’ PAYMENTS, THE NUMBER OF DAYS TO ALLOW FOR PAYMENTS TO REACH YOUR PAYEE DEPENDS ON THE LOCATION OF THE PAYEE. USE THE FOLLOWING RECOMMENDATIONS TO ENSURE YOUR PAYMENT IS RECEIVED ON TIME.
• PAYEES LOCATED IN CENTRAL OR EASTERN U.S., ALLOW A MINIMUM OF FIVE (5) BUSINESS DAYS;
• MIDWEST, ALLOW A MINIMUM OF SEVEN (7) BUSINESS DAYS;
• WEST COAST AND HAWAII, ALLOW A MINIMUM OF EIGHT (8) BUSINESS DAYS.
Bill payments can be changed or canceled, provided you access the Bill Payment service prior to the cut-off time on the business day before the business day the bill payment is to be processed.
Due to circumstances beyond the control of the service, particularly delays in handling and posting payments by the payee, some transactions may take a few days longer to be credited by the payee to your account.
You agree to have available and collected funds on deposit in the account you designate in amounts sufficient to pay for all bill payments requested, as well as, any other payment obligations you have to the Bank. The Bank reserves the right, without liability, to reject or reverse a bill payment if you fail to comply with this requirement or any other terms of this agreement. If you do not have sufficient funds in the Account and the Bank has not exercised its right to reverse or reject a bill payment, you agree to pay for such payment obligations on demand. You further agree that the Bank, at its option, may charge any of your accounts with the Bank to cover such payment obligations. The Bank reserves the right to change the cut-off time. You will receive notice if the cut-off time changes.

PAYMENT LIMITS
The Bank, in its discretion, may set limits on the dollar amount of payments and/or transfers the number of payments and/or transfers that may be made through the bill payment service, including without limitation daily, weekly, monthly, and per transfer limits.

THE BILL PAYMENT PROCESS
Single Payments
A single payment will be processed on the business day (generally Monday through Friday, except certain holidays) that you designate as the payment’s process date, provided the payment is submitted prior to the daily cut-off time on that date. The daily cut-off time, which is controlled by the Bank, is currently 2:00 PM EST. A single payment submitted after the cut-off time on the designated process date will be processed on the following business day. If you designate a non-business date (generally weekends and certain holidays) as the payment’s process date, the payment will be processed on the first business day following the designated process date.
Recurring Payments
When a recurring payment is processed, it is automatically rescheduled by the system. Based upon your selected frequency settings for the payment, a process date is calculated for the next occurrence of the payment. If the calculated process date is a non-business date (generally weekends and certain holidays), it is adjusted based upon the following rules:
• If the recurring payment’s “Pay Backward” option is selected, the process date for the new occurrence of the payment is adjusted to the first business date prior to the calculated process date.
• If the recurring payment’s “Pay Backward” option is not selected (or if the “Pay Backward” option is not available), the process date for the new occurrence of the payment is adjusted to the first business date after the calculated process date.
Note: If your frequency settings for the recurring payment specify the 29th, 30th, or 31st as a particular day of the month for processing and that day does not exist in the month of the calculated process date, then the last calendar day of that month is used as the calculated process date.
Estimated Arrival Date - The system will calculate the Estimated Arrival Date of your payment. This is only an estimate, so please allow ample time for your payments to reach your Payees.
Payment Methods – The Bank and the bill payment service reserve the right to select the method in which to remit funds on your behalf to your Payee. These payment methods may include, but may not be limited to, an electronic (or ACH) payment, an electronic to check payment, a paper check, or a laser draft payment.

CANCELLING A PAYMENT
By following the directions within the bill payment service, bill payments can be changed or cancelled any time prior to the cutoff time on the scheduled processing date. There is no charge for canceling or editing a scheduled payment prior to the scheduled processing date. Once the bill payment service has begun processing a payment, it cannot be cancelled or edited. If processing has already begun and you wish to cancel the payment, you will need to submit a stop payment request. You will be responsible for the applicable stop payment fees.

STOP PAYMENT REQUESTS FOR PAPER CHECKS
Stop payment requests for paper checks may be initiated through the Online Banking System, in person at a branch, or by calling the Bank at (814)443-9200 or at (800) 972-1651. This service is not available within the bill payment service.

AVAILABLE FUNDS
The Bank is not responsible for executing your Bill Pay instructions if your deposit account does not contain sufficient funds to complete your transaction or if the transaction would exceed the credit limit of your overdraft protection. If the Bank executes your payment instruction even though your deposit account does not contain sufficient funds to complete the transaction or the transaction would exceed the credit limit of your overdraft protection, you are responsible for the amount of the payment and any applicable overdraft fees as defined in your deposit agreement and the Bank’s Fee Schedule.

RETURNED PAYMENTS
In using the bill payment service, you understand that Payees and/or the United States Postal Service may return payments to the bill payment service for various reasons including without limitation, Payee’s forwarding address expired; Payee account number is not valid; Payee is unable to locate account; or Payee account is paid in full. The Bank and the bill payment service will use its best efforts to research and correct the returned payment and return it to your Payee, or void the payment and credit your account. You may receive notification from the bill payment service. The Bank is not liable for any returned payments or any damages or loss, including without limitation late fees, related to any returned payments.

FAILED OR RETURNED TRANSACTIONS
In using the bill payment service, you are requesting the bill payment service to make payments for you from your deposit account. If the Bank is unable to complete the transaction for any reason associated with your deposit account (for example, there are insufficient funds in your account to cover the transaction), the transaction may not be completed. In some instances, you will receive a return notice from the bill payment service. In such case, you agree that:
1. You will reimburse the Bank immediately upon demand the transaction amount that has been returned;
2. For any amount not reimbursed to the Bank within fifteen (15) days of the initial notification, a late charge equal to 1.5% monthly interest or the legal maximum, whichever rate is lower, for any unpaid amounts may be imposed;
3. You will reimburse the Bank for any fees it or the Bank’s service provider incurs in attempting to collect the amount of the return from you; and,
4. The Bank and/or the Bank bill payment service provider are authorized to report the facts concerning the return to any credit reporting agency.

PROHIBITED PAYMENTS
You agree not to use the bill payment service or the content or information delivered through bill payment service in any way that would: (a) infringe any third-party copyright, patents, trademark, trade secret, or other proprietary rights or rights of publicity or privacy; (b) be fraudulent or involve the sale of counterfeit or stolen items; (c) violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); (d) be false, misleading or inaccurate; (e) create liability for the Bank or its affiliates or service providers, or cause the Bank to lose (in whole or in part) the services of any of the Bank’s service providers; (f) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (g) potentially be perceived as illegal, offensive or objectionable; (h) interfere with or disrupt computer networks connected to the Bill payment service; (i) interfere with or disrupt the use of the Bill payment service by any other user; (j) impose an unreasonable or disproportionately large load on the Bank’s infrastructure; (k) facilitate any viruses, trojan horses, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information; (l) constitute use of any robot, spider, other automatic device, or manual process to monitor or copy the Service or the portion of the Site through which the Service is offered without the Bank’s prior written permission; (m) constitute use of any device, software or routine to bypass technology protecting the Bank’s website or the bill payment service, or interfere or attempt to interfere, with the Bank’s website or the bill payment service; (n) may cause the Bank or its service providers to lose any of the services from the Bank’s internet service providers, payment processors, or other vendors or (o) use the bill payment service in such a manner as to gain unauthorized entry or access to the computer systems of others. The Bank has the right but not the obligation to monitor for, block, cancel and/or reverse payments involving any of the above.
Payments prohibited through the Bill payment service are (a) payments involving any of the uses described above; (b) payments to or from persons or entities located in prohibited territories (including any territory outside of the United States); (c) payments that violate any law, statute, ordinance or regulation, including without limitation any payments for unlawful internet gambling; and/or (d) payments that violate the Acceptable Use terms provided below.
In no event shall the Bank or its service providers be liable for any claims or damages resulting from your scheduling of prohibited payments. The Bank has no obligation to research or resolve any claim resulting from a prohibited payment. All research and resolution for any misapplied, mis-posted or misdirected prohibited payments will be your sole responsibility.

eBILL PROCESS
User Content
Subject to the Bank’s Privacy Policy, you agree that the Bank may use, copy, modify, display and distribute any information, data, materials or other content (the “Content”) you provide to the Bank in order to use eBills, and you hereby give the Bank a license to do so. By submitting Content, you represent that you have the right to license such Content to the Bank for the purposes set forth in this Agreement.
Third Party Accounts
You understand and agree that, in order to provide eBills, it is necessary for the Bank to access third party Web sites and data bases containing information regarding your accounts and financial relationships as designated by you ("Third Party Accounts"), on your behalf, to retrieve information as requested or authorized by you. Accordingly, we will ask you to provide information needed to access your Third Party Accounts, and we will use this information only on your behalf and to carry out your instructions.
By using eBills, you authorize the Bank to access such Third Party Accounts to retrieve such Content as requested or authorized by you, or for any other purpose authorized by this Agreement. You warrant and represent that the information you are providing the Bank with is true, correct and complete. You represent and warrant to the Bank that you have the right to authorize and permit us access to your Third Party Accounts, you assure us that by disclosing the information to us and by authorizing us to use such information to access your Third Party Accounts you are not violating any third party rights.
You authorize and permit the Bank to use Content and other information submitted by you to the Bank (such as account passwords and user names) to accomplish these purposes and to configure the eBills to be compatible with the Third Party Accounts.
For as long as you are using eBills, you give to the Bank a limited power of attorney and appoint the Bank as your true and lawful attorney-in-fact and agent, with full power of substitution and re-substitution, for you and in your name, place and stead, in any and all capacities, to access the Third Party Accounts, retrieve Content, and use your Content, all as described above, with the full power and authority to do and perform each and every act and thing requisite and necessary to be done in connection with the eBills, as fully to all intents and purposes as you might or could do in person.
Once the Bank has actual knowledge that you wish to cease using the eBills as provided in this Agreement or as otherwise permitted in this Agreement and has a reasonable opportunity to act on such knowledge, this limited power of attorney is automatically revoked; provided, however, that any act done by the Bank in good faith before it has actual knowledge of termination by you shall be deemed to be authorized by you. To notify the Bank that you wish to discontinue using the eBills, you must do so at the bill pay site.
YOU UNDERSTAND AND AGREE THAT AT ALL TIMES YOUR RELATIONSHIP WITH EACH THIRD PARTY ACCOUNT PROVIDER IS INDEPENDENT OF THE BANK AND YOUR USE OF THE EBILLS. SOMERSET TRUST COMPANY WILL NOT BE RESPONSIBLE FOR ANY ACTS OR OMISSIONS BY THE BILLER OR OTHER PROVIDER OF ANY THIRD PARTY ACCOUNT, INCLUDING WITHOUT LIMITATION ANY MODIFICATION, INTERRUPTION OR DISCONTINUANCE OF ANY THIRD PARTY ACCOUNT BY SUCH PROVIDER.
YOU ACKNOWLEDGE AND AGREE THAT WHEN THE BANK IS ACCESSING AND RETRIEVING INFORMATION FROM THE THIRD PARTY ACCOUNTS, THE BANK IS ACTING AS YOUR AGENT, AND NOT AS THE AGENT OF OR ON BEHALF OF THE THIRD PARTY. YOU AGREE THAT THE BANK, ITS’ AFFILIATES AND PARTNERS SHALL BE ENTITLED TO RELY UPON THE FOREGOING AUTHORIZATION, AGENCY AND POWER OF ATTORNEY GRANTED BY YOU.
YOU AGREE THAT SOMERSET TRUST COMPANY SHALL NOT BE LIABLE FOR ANY COSTS, FEES, LOSSES OR DAMAGES OF ANY KIND INCURRED AS A RESULT OF (1) THE BANK’S ACCESS TO THE THIRD PARTY ACCOUNTS; (2) THE BANK’S RETRIEVAL OF OR INABILITY TO RETRIEVE INFORMATION FROM THE THIRD PARTY ACCOUNTS; (3) ANY INACCURACY, INCOMPLETENESS OR MISINFORMATION CONTAINED IN CONTENT RETRIEVED FROM THE THIRD PARTY ACCOUNTS AND (4) ANY CHARGES IMPOSED BY THE PROVIDER OF ANY THIRD PARTY ACCOUNT.
Alert Service
The alert service enables you to receive a notice via email or other devices concerning available information in your Third Party Accounts. You can set alerts for each of your Third Party Accounts registered on the eBills. You are responsible for determining the criteria that governs the alert and the eBills will send an alert to you based upon the instructions you provide to us. Your instructions are neither reviewed nor verified by the Bank prior to or following activation of any alert. At any point, you can enable or disable an alert, or delete the alert altogether.
YOU UNDERSTAND AND ACCEPT THAT AN ALERT IS TRANSMITTED ELECTRONICALLY AND YOU ACKNOWLEDGE THAT YOU HAVE NO EXPECTATION OF PRIVACY WITH RESPECT TO SUCH INFORMATION. YOU ACKNOWLEDGE THAT THE INFORMATION IN THE ALERT IS UNENCRYPTED AND CAN BE ACCESSED, USED, OR MISAPPROPRIATED BY UNINTENDED THIRD-PARTY RECIPIENTS. THE BANK IS NOT RESPONSIBLE FOR ANY UNAUTHORIZED USE OR MISAPPROPRIATION OF ANY AND ALL INFORMATION TRANSMITTED THROUGH THE ALERT. THE BANK DOES NOT GUARANTEE THE DELIVERY OR THE ACCURACY OF THE CONTENTS OF EACH ALERT. YOU ACKNOWLEDGE AND AGREE THAT DELIVERY OF AN ALERT MAY BE DELAYED OR PREVENTED BY FACTOR(S) OUTSIDE OUR CONTROL.
THE BANK PROVIDES THIS SERVICE AS A CONVENIENCE TO YOU FOR INFORMATION PURPOSES ONLY. THE BANK RESERVES THE RIGHT TO TERMINATE ITS ALERT SERVICE AT ANY TIME WITHOUT PRIOR NOTICE TO YOU. THE BANK SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES CAUSED BY (A) NON-DELIVERY, DELAYED DELIVERY, OR THE MISDIRECTED DELIVERY OF AN ALERT; (B) INACCURATE OR INCOMPLETE INFORMATION IN AN ALERT; OR (C) YOUR RELIANCE ON OR USE OF THE INFORMATION PROVIDED IN AN ALERT FOR ANY PURPOSE.
Links To Third Party Sites
The eBills may contain links to other Web sites ("Linked Sites"). Such links are provided solely as a convenience for you. While the Bank will attempt to select and provide links to Linked Sites that it believes may be of interest to its customers, the Bank does not screen, approve, review or otherwise endorse any content or information contained in any Linked Sites. You acknowledge and agree that Bank, its affiliates, service providers, agents and partners are not responsible for the contents of any Linked Sites, including the accuracy or availability of information provided by Linked Sites, and makes no representations or warranties regarding the Linked Sites or your use of them.

ELECTRONIC COMMUNICATIONS
The Service is an electronic, Internet based-service. Therefore, you understand and agree that this Agreement will be entered into electronically, and that the following categories of information ("Communications ") may be provided by electronic means:
• This Agreement and any amendments, modifications or supplements to it.
• Any initial, periodic or other disclosures or notices provided in connection with the Service, including without limitation those required by federal or state law.
• Any customer service communications, including without limitation communications with respect to claims of error or unauthorized use of the Service.
• Any other communication related to the Service.
Although the Bank reserves the right to provide Communications in paper format at any time, you agree that we are under no obligation to do so. All Communications in either electronic or paper format will be considered to be "in writing." You should print a paper copy of this Agreement and any electronic Communication that is important to you and retain the copy for your records. If you are not willing to receive this Agreement or the Communications electronically, you may not use the Service.
You agree to promptly update your registration records if your e-mail address or other information changes. You may update your records, such as your e-mail address, at the bill pay site.
Communications may be posted on the pages of the bill pay site and/or delivered to the e-mail address you provide. All electronic Communications sent by e-mail will be deemed to have been received by you when the Bank sends it to you, whether or not you received the e-mail. If the Communication is posted on the bill pay site, then it will be deemed to have been received by you no later than five (5) business days after Bank posts the Communication on the pages of the bill pay site, whether or not you retrieved the Communication. An electronic Communication by e-mail is considered to be sent at the time that it is directed by the Bank’s e-mail server to the appropriate e-mail address. An electronic Communication by posting to the pages of the bill pay site is considered to be sent at the time it is publicly available.
You agree that these rule and procedures are reasonable and that they shall govern the sending and receiving of electronic Communications.

HARDWARE AND SOFTWARE
You are responsible for obtaining, installing, maintaining and operating all computer hardware, software, and internet access necessary for use of the Bill payment services, including without limitation virus protection software and spyware/malware. The Bank and its service providers are not responsible for any errors or failures from the malfunction or failure of your hardware, software, or internet access services.

LIABILITY
You are solely responsible for controlling the safekeeping of and access to, your Personal Identification Number (PIN).
You are liable for all transactions you make or that you authorize another person to make even if that person exceeds his or her authority. You hereby indemnify and release the Bank from any and all liability and agree not to make any claim against the Bank or bring any action against the Bank honoring or allowing any bill payments where you have authorized the person performing the bill payment to use your account or when you have provided your PIN to that person. You agree to reimburse the Bank for any losses it suffers or any damages, injuries, costs or expenses it incurs (including attorney’s fees) as a result of the Bank’s honoring or allowing bill payments on the account where the PIN was used. If you want to terminate another person's authority, you must notify the Bank and arrange to change your PIN.
You will be responsible for any Bill Payment request you make that contains an error or is a duplicate of another Bill Payment. The Bank is not responsible for a Bill Payment that is not made if you did not properly follow the instructions for making a Bill Payment.
The Bank is not liable for any failure to make a Bill Payment if you fail to promptly notify us after you learn that you have not received credit from a Payee for a Bill Payment.
The Bank is not responsible for your acts or omissions or those of any other person, including, without limitation, any transmission or communications facility, and no such party shall be deemed to be the Bank’s agent.
In any event, the Bank will not be liable for any special, consequential, incidental, or punitive losses, damages, or expenses in connection with this Agreement or the Service, even if we have knowledge of the possibility of them. The Bank is not liable for any act, failure to act or delay in acting if it is caused, in whole or in part, by any cause beyond the Bank's reasonable control.
The limitations of liability set forth in this agreement are subject to, and limited by any state or federal law to the contrary.

NO UNLAWFUL OR PROHIBITED USE
As a condition of using the Service, you warrant to the Bank that you will not use the Service for any purpose that is unlawful or is not permitted, expressly or implicitly, by the terms of this Agreement or by any applicable law or regulation. You further warrant and represent that you will not use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Service. You agree that these warranties and representations will remain in full force and effect even if this Agreement terminates for any reason.

AMENDMENT AND TERMINATION
The Bank has the right to change this Agreement at any time by notice mailed to you at the last address shown for the Account on the Bank's records, by posting notice in branches of the Bank, or as otherwise permitted by law.
The Bank may modify or discontinue the Service or your account with the Bank with or without notice to you, any other user or any third party. The Bank reserves the right to terminate your account at any time and for any reason, including without limitation if the Bank, in its sole judgment, believes you have engaged in conduct or activities that violate any of the Terms or Conditions of the Service, or if you provide the Bank with false or misleading registration information or interfere with other users or the administration of the Service.
You may terminate the Service at any time by using the online feature on the bill pay site or within online banking to unsubscribe. You may contact a service representative for assistance if you are unsure how to accomplish this. You may terminate this Agreement by written notice to the Bank. After the Bank has accepted your termination of the Service, the Bank will not access your Third Party Accounts thereafter for any reason, however we may, at our discretion, continue to make information available to you that was collected prior to the Service being terminated. THE BANK IS NOT RESPONSIBLE FOR ANY FIXED PAYMENT MADE BEFORE THE BANK HAS A REASONABLE OPPORTUNITY TO ACT ON YOUR TERMINATION NOTICE. YOU REMAIN OBLIGATED FOR ANY PAYMENTS MADE BY THE BANK ON YOUR BEHALF.
If the Service with the Bank is terminated for any reason, you will have no further right or access to use the Service, and the Bank will not access your Third Party Accounts thereafter for any reason.

FEE SCHEDULE
Bill Payment service charges may be assessed based on the services provided. You agree to pay such charges and authorize us to automatically charge your designated checking account for bill payment for these amounts and any additional charges that may be incurred by you.

Bill Payment Fee: You will not be charged for actively using STC OnLine BillPay. A $5.00 inactivity fee will be charged if no payments are made during any 2-month period based on the anniversary date of your enrollment. As long as at least one payment is made during the 2-month period, your account will not be charged. If you do not use the service during a 2-month period based on your enrollment date, your account will be charged the $5.00 inactivity fee. If you use the service during the next 2-month period, you will not be charged.
Fees are subject to change.

ADDITIONAL CHARGES FOR SERVICES AND OTHER ITEMS
These charges will only be assessed if you request one or more of the services listed here. There will be NO Charge for any item if needed to correct a Bank error.
• Written Correspondence to Payee: $10.00, $15.00 per letter mailed Express Mail
• Per proof of Payment not necessitated by a dispute: $10.00
• Cancellation of each request for payment before disbursement: $7.50
• Payments returned due to customer error: $5.00
• ACH Return fee: $10.00
• Overdraft Fees: As per Bank Overdraft Fee schedule.
• Expedited Payments: $14.95 (next business day) and $9.95 (second business day)
• Gift Payments: $2.99
• Charitable Payments: $1.99
The Bank reserves the right to charge you for research time involving payments no longer available in your screen history. You will be informed of any such charges before they are incurred.
Additional charges for services and other items are subject to change.

BILL PAYMENTS ARE PROCESSED BY ELECTRONIC FUND TRANSFERS (EFT).

ERRORS AND QUESTIONS
This section applies only to electronic funds transfers governed by the EFTA and REG E.

If you think your statement or receipt is incorrect or if you need more information about a transfer listed on the statement or receipt, we must hear from you no later than sixty (60) days after we send or deliver to you the FIRST statement on which the problem or error appeared.
1. Tell us your name and account number(s).
2. Describe the error or the transfer you are unsure about, the date it occurred, and explain as clearly as you can why you believe it is an error or why you need more information.
3. Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send in your complaint or question in writing within ten (10) business days. We will determine whether an error occurred within 10 business days (20 business days if the transfer involved a new account) after we hear from you and will correct any error promptly.

If we need more time, however, we may take up to forty-five (45) days (90 days if the transfer involved a new account, a point-of-sale transaction, or a foreign-initiated transfer) to investigate your complaint or question. If we decide to do this, we will credit your account within ten (10) business days (20 business days if the transfer involved a new account) for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and do not receive it within ten (10) business days, we may not credit your account.
Your account is considered a new account for the first thirty (30) days after the first deposit is made, unless you already have an established account with us before this account is opened.

We will tell you the results within three (3) business days after we finish our investigation. If we decide there was no error, we will send you a written explanation.

You may ask for copies of the documents that we used in our investigation.
