BILL PAYMENT AGREEMENT AND DISCLOSURES
INTRODUCTION
The terms "our," "we," "us," "ICCU," and "Credit Union" refer to Idaho Central Credit Union. "You" and “your” refers to each and all signers on an account at the Credit Union. The term "business day" means Monday through Friday, excluding Federal holidays. This Agreement explains the terms and conditions governing our Bill Payment Service (hereinafter referred to as Bill Payment). By using Bill Payment you agree to abide by the terms and conditions of this Agreement. This Agreement will be governed by and interpreted in accordance with federal law and regulation, and to the extent there is no applicable federal law or regulation, by the laws of the State of Idaho.
Bill Payment is provided for use by members of Idaho Central Credit Union. Unauthorized usage is strictly prohibited.
Bill Payment is an Electronic Funds Transfer service and you are protected by the Electronic Funds Transfer Act (EFTA) and the Federal Reserve's Regulation E. You are subject to the terms and conditions related to electronic services as described in our Important Account Information for Our Members brochure. A copy of the brochure was provided to you when you opened your account with us. You may request a copy at any time. See the Contact Us section at the end of this agreement.
You may use Idaho Central Credit Union bill paying service, Bill Payment to direct Idaho Central Credit Union to make payments from your designated checking account to the “Payees” you choose in accordance with this agreement. The terms and conditions of this agreement are in addition to the account agreements, disclosures and other documents in effect from time to time governing your account.
ACCESS
If we approve your application for Bill Payment, you will need your personal computer to access your accounts. You are responsible for the installation, maintenance and operation of any software or hardware. Idaho Central will not be responsible for any errors or failures caused by or related to telephone service, Internet service, hardware, or software.
Availability
Bill Payment is accessible seven days a week, twenty-four hours a day. If we schedule downtime for maintenance, we will post a notice. We will attempt to post notices in case of unscheduled downtime but circumstances may prevent such notice.
Software Requirements
Bill Payment requires Internet access and a Web browser capable of 128-bit encrypted connections. Bill Payment is operating system neutral. Currently bill payment is optimized for use with:
o Internet Explorer 7 and above o Firefox 7 and above o Safari 5 for Windows and Mac o Google Chrome 16 and above
New version releases of supported brands will be automatically included as long as they are part of a general public release and not an early test release, such as a beta release. These will not be supported.
Idaho Central reserves the right to change software requirements as needed. Under normal conditions we will provide notice of such software requirements before the need is mandatory. However, if conditions warrant we reserve the right to make changes immediately without notice.
The eBranch Bill Payment Service allows you to schedule bill payments to payees of your choice.
You must have an active checking account in good standing to make bill payments.
You can arrange, at your option, for the payment of your current, future, and recurring bills from your checking account. By furnishing us with the names of your payees and their addresses, you authorize us to follow the payment instructions to these payees that you provide us via the Bill Payment service.
SCHEDULING BILL PAYMENTS
Payees: If you want to add a new “Payee,” first select the “Payee” tab located in the bill pay or speak to a service representative. • We reserve the right to refuse the designation of a “Payee” for any reason.
Payments: You may add a new payment to a “Payee” by accessing the service and entering the appropriate information. Most other additions, deletions, or changes can be made in writing or by using the service. • You may pay any “Payee” with-in the United States (including U.S. territories and APO’s / AEO’s). • We are not responsible for payments that cannot be made due to incomplete, incorrect, or outdated information.
THE BILL PAYING PROCESS
Single Payments – A single payment will be processed on the business day (generally Monday through Friday, except certain holidays) that you designate as the payment’s processing date, provided the payment is submitted prior to the daily cut-off time on that date. The daily cut-off time, which is controlled by us, is currently 2:00pm.
A single payment submitted after the cut-off time on the designated process date will be processed on the next business day. If you designate a non-business date (generally weekends and certain holidays) as the payment’s processing date, the payment will be processed on the first business day following the designated processing date.
Recurring Payments – When a recurring payment is processed, it is automatically rescheduled by the system. Based upon your selected frequency settings for the payment, a processing date is calculated for the next occurrence of the payment. If the calculated processing date is a non-business date (generally weekends and certain holidays), it is automatically adjusted. The processing date for the new occurrence of the payment will be the first business day prior to the calculated processing date.
Note: If your frequency settings for the recurring payment specify the 29th, 30th, or 31st as a particular day of the month for processing and that day does not exist in the month of the calculated processing date, then the last calendar day of that month is used as the calculated processing date.
SINGLE AND RECURRING PAYMENTS
The system will calculate the Estimated Arrival Date of your payment. This is only an estimate, so please allow ample time for your payments to reach your “Payees”.
Be sure to take into account that, although you can schedule a payment at any time, payments are actually initiated (sent to the payee) only on business days.
Please be sure to allow sufficient time for your payee to receive your payment and credit your account properly. To avoid incurring finance or other charges, you should schedule your payment to arrive on or before the payee's stated due date.
CANCELLING A PAYMENT
You have the right to stop or change any scheduled bill payment. However, you must cancel a payment by no later than 2 PM MST on the processing date.
NO DUTY TO MONITOR PAYMENTS
We have no duty to monitor your payments made through the Bill Payment service. If you or any authorized user of your account makes a payment which is not yours, you assume the entire risk of loss and indemnify and hold us, our directors, officers, employees and agents harmless from all loss, liability, claims, demands, judgments and expenses arising out of or in any way connected with such use.
If you schedule a payment to a payee where you no longer have an account relationship, we are under no obligation to stop, retrieve, cancel, or otherwise monitor the payment. You must retrieve your payment from the payee and cancel future payments on the Bill Payment system.
WAIVER OF REQUIREMENT FOR TWO SIGNATURES
You recognize that any requirement of verifying two signatures on checks, if such a requirement exists, does not apply to online bill payments, and releases us from liability when making such payments. This means that any person who is authorized to act as a signer on your account shall be authorized by you to individually make online bill payments from your account, even though that person's authority to transfer or withdraw funds from your account by some other means (e.g., by check) must be exercised jointly with one or more other persons.
PAYMENTS ON BEHALF OF THIRD PARTIES
You agree not to make bill payments to payees on behalf of third parties unless the third party is a joint account holder on your account and the payment is made payable to either your account or an account in the name of the joint account holder.
ACTS OF NATURE
We are not liable for failure to make bill payments if such failures are outside of our control, including but not limited to acts of nature and other situations as regulated by EFTA and Regulation E.
CANCELING YOUR BILL PAYMENT SERVICE
If you close your checking account, you must notify us to cancel your bill payment service.
If you terminate the Bill Payment service or your Bill Payment account, you must cancel all future bill payments at the same time by deleting the payments. This will ensure future payments will not be processed.
If you wish to discontinue Bill Payment service, you should contact Idaho Central Credit Union.
AVAILABLE FUNDS
We are under no obligation to honor your payment request if there are insufficient available funds in your account (or your credit lines are unavailable); if a legal order directs us to prohibit withdrawals from your account; if the account is closed or frozen or your account is no longer in good standing; or if any part of the electronic funds transfer system is not working properly.
LIABILITY
We are not responsible for any charges imposed or any other action taken by your payee for any reason. This limitation includes any finance charges and late fees. We are not liable for indirect, special, or consequential damages arising out of the use of the Bill Payment service.
We are not liable for bill payments made either directly or indirectly to your payee by us or by third parties. If your bill payment fails for any reason, you agree to research and reconcile the failure with your payee without intervention by us. o If you want to terminate another person's authority to use the Bill Pay service, you must notify us and arrange to change your PIN. o You will be responsible for any bill payment request you make that contains an error or is a duplicate of another bill payment. o We are not responsible for a bill payment that is not made if you did not properly follow the instructions for making a bill payment. o If you followed all instructions for making a bill payment but did not receive credit from a “Payee”, you may have rights to dispute the bill payment. Failing to promptly notify us that you did not receive credit may affect your ability to dispute the transaction. o We are not responsible for your acts or omissions or those of any other person, including, without limitation, any transmission or communications facility, and no such party shall be deemed to be the ICCU’s agent.
AMENDMENT
We have the right to change this agreement at any time by notice mailed to you at the last address shown for the account on our records, by posting notice in our branches, or as otherwise permitted by law.
TERMINATION
o We have the right to terminate this agreement at any time. o You may terminate this agreement by written notice to ICCU or in person at any of our branch locations. o We are not responsible for any fixed payment made before we have a reasonable opportunity to act on your termination notice. o You remain obligated for any payments made by us on your behalf.
